Catherine was employed by Herdmans in Sion Mills for a 6 year period between 1984 and 1990. She was employed as a winder in the winding room in Herdmans. She was exposed to excessive noise from large winding machines on a daily basis during the course of her employment.
Catherine went on to work as a machinist for Desmonds in Omagh between 1990 and 1992. This was a noisy working environment and the noise emanated from a large number of machines on the factory floor.
Catherine then worked for Daintifyt in Plumbridge between 1992 and 2000. She was employed as a machinist working on industrial sewing machines making underwear.
During the course of all of these employments, Catherine was required to be in the vicinity of noisy machinery and was not provided with ear protection.
Following these employments, Catherine became aware that her hearing was deteriorating. She also attended her GP with regards to tinnitus, which regularly delayed her onset of sleep for several hours at night.
Catherine contacted Millar McCall Wylie to discuss a potential hearing loss claim. She had heard about our extensive experience in the area of hearing loss and industrial disease claims from a former work colleague.
We took initial instructions from Catherine and arranged for her to attend for a hearing test and consultation with a Consultant ENT Surgeon. The hearing test demonstrated evidence of Noise Induced Hearing Loss. The report from the Consultant ENT Surgeon attributed a proportion of her hearing loss and tinnitus as due to her time working in Herdmans, Desmonds and Daintifyt.
We sent a letter of claim to the insurers for Herdmans, Desmonds and Daintifyt and subsequently issued legal proceedings against the three defendants. Following receipt of a defence medical report, we entered into discussions with the defendants’ legal representatives and successfully negotiated a settlement of £10,000.00.
